MDL

The United States Judicial Panel on Multidistrict Litigation, known informally as the MDL Panel, was created by an Act of Congress in 1968. The Panel’s job is to determine whether civil actions pending in different federal districts involve one or more common questions of fact such that the actions should be transferred to one federal district for coordinated or consolidated pretrial proceedings. The Panel is also charged with selecting the judge or judges and court assigned to conduct the MDL. The purpose of the MDL is to:

  • Avoid duplication of discovery
  • Prevent inconsistent pretrial rulings
  • Conserve the resources of the parties, their counsel and the judiciary. 

The Panel has considered motions for centralization in almost 2,400 dockets involving nearly 400,000 cases and millions of claims therein including litigation categories such as: 

  • Airplane crashes
  • Other single accidents, such as train wrecks or hotel fires
  • Mass torts, such as those involving asbestos, drugs, and other product liability cases
  • Patent validity and infringement 
  • Antitrust price fixing
  • Securities fraud
  • Employment practices

Some of the largest MDL cases, according to the Legal Information Institute at Cornell University School of Law include:

MDL No. 875 was created in 1991 to manage all asbestos personal injury and wrongful death suits in federal court. Based in the Eastern District of Pennsylvania, it is the longest-lasting MDL. As of 2011, over 121,000 cases had been transferred into MDL No. 875, and over 108,000 cases had been settled, dismissed, or remanded, leaving about 13,000 pending.

MDL No. 2179 consists of about 200 Oil Spill by the Oil Rig Deepwater Horizon cases pending before the U.S. District Court for the Eastern District of Louisiana. Subsequent oil spill cases relating to Deepwater Horizon filed in federal court will ordinarily be transferred to this district court to become part of MDL 2179 as "Tag Along" cases.

MDL 2325, 2326, 2327, 2187 and 2387 consist of vaginal mesh cases consolidated in the Southern District of West Virginia before the Honorable Judge Joseph Goodwin. Transvaginal mesh is now the largest MDL in U.S. history, according to drugwatch.com.

Some notable settlements for MDLs include $4.75 billion in Fen-Phen Diet Drugs Litigation MDL 1203; $4.25 billion in silicone gel breast implants litigation MDL 926; $3.3 billion in ACC/Lincoln Savings Security Litigation securities fraud class action.
