Third Party Divorce Litigation Funding

Kingston White wrote in the Journal Of Law and Family Studies about the need to regulate the legal financing industry.  He is a senior staff member of the Journal of Law and Family Studies. The article titled A Call For Regulating Third Party Divorce Litigation Funding. According to him, third party funding would just push people to divorce and hold out for a longer time than they normally would. He claims it would prolong the excruciating process that is divorce.

The author ignores that many divorces end up being very contentious and acrimonious and that is sometimes a factor in why the parties hold out. That happens whether litigation funding companies are in the picture or not. In some cases, both parties try to go for everything. This takes time to work out which means more legal fees which, depending on the situation, could be a disaster.

Litigation funding can help people who need money going through a divorce. It is not uncommon for people to become destitute while pursuing this action. However it is an interesting counterpoint and a good read.
